Terms and conditions of use

These terms of use (together with all documents referred to in these terms) (collectively referred to as the "Agreement") tell you the terms and conditions on which you may use and access the Finextra web site.

www.finextra.com (the "Finextra web site") is a web site operated by Finextra Research Limited (referred to in this Agreement as "Finextra", "we", "us" or "our").

Accessing the Finextra web site

The supply of any goods, services and information offered by third party providers listed on the Finextra web site is subject to the relevant third party's terms and conditions relating to the provision of their goods, services and information. Our liability
Nothing in this Agreement shall exclude or limit our liability for: (a) death or personal injury arising through negligence; (b) fraudulent misrepresentation; (c) breach of implied terms relating to title and quiet enjoyment under Section 12 of the Sale of Goods Act 1979 and Section 2 of the Sale and Supply of Goods Act 1982; or (d) any other liability which may not lawfully be excluded or limited by us.

Commentary and other materials posted on the Finextra web site are only general remarks or comments and are not intended to be relied upon by you. Except where stated otherwise in this Agreement, we exclude all liability and responsibility arising from any reliance placed on third party content on the Finextra web site by you or anyone who may be informed of any of its contents. We do not warrant or guarantee that material downloaded and/or accessed via or from the Finextra web site will be free of viruses or other similar contaminants and you should operate the most up-to-date virus protection software at all times. Except where stated otherwise in this Agreement, we do not accept responsibility for any loss, damages or costs suffered or incurred by you arising from viruses or contaminants contracted by you or your machine from accessing or using the Finextra web site.

Jurisdiction and applicable law
The English Courts will have exclusive jurisdiction over any claim arising from or related to the Finextra web site. English Law will apply to the construction and interpretation of this Agreement.

Finextra Privacy Policy
Following below is the formal privacy statement, which gets quite long and unwieldy when the law becomes involved. We like to think we are reasonable people and good internet citizens, so if you have any concerns or issues around privacy, please get in touch and let's discuss them.

Our commitment to privacy
Your privacy is important to us. To better protect your privacy we provide this notice explaining our online privacy practices and the choices you can make about the way your information is collected and used.

The information we collect
This notice applies to all information collected or submitted on the Finextra web site. Finextra Research Limited is the sole owner of the information collected on this web site.

Our site collects non-personally identifiable information about you, such as the server your computer is logged onto and your browser type. This information is purged or automatically deleted when you close your Internet browser.

If you subscribe to the web site then we will collect some personal information about you. This information will not be sold, shared with, or rented to other parties outside of Finextra Research Limited, and will be deleted if requested by the user.

If you wish to download documents, resources and reports, register for webinars, conferences and other services, or participate in sales promotions, you will be offered the option to opt-in to share your information with Finextra Research Limited and/or any third parties. Usually this will be one of our sponsoring customer organizations, sometimes it may be service providers helping us operate webinars or conferences. If you do not wish to share your personal information for the purpose stated do not opt-in.

If, at any time, you prefer not to receive emails from us, please log into the members area and select the unsubscribe link or email contact@finextra.com. You will be able to unsubscribe anytime by clicking on the unsubscribe link at the bottom of all our email communications.

Use and storage of your personal information
When you supply any personal information to Finextra we have legal obligations towards you in the way we deal with that data. We must collect the information fairly, that is, we must explain how we will use it and tell you if we want to pass the information on to anyone else. Finextra will only disclose PII if required to do so by law. With that exception, under no circumstances will we share single user or aggregated demographic data without the explicit consent of our users.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

Notifications of changes
If we decide to change our privacy policy, we will post those changes to the Finextra web site (www.finextra.com), so users of the site are always aware of what information we collect, how we use it and under what circumstances, if any, we will disclose it. If at any point we decide to use PII in a manner different from that stated at the time it was collected, we will notify subscribers by e-mail. What are your rights?

If at any point you believe the information we process on you is incorrect you request to see this information and even have it corrected or deleted. If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Protection Officer who will investigate the matter.

If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law you can complain to the Information Commissioner’s Office (ICO).
